Abstract

The current analysis of regulatory administrative sanctions is structured upon three incorrect premises. The need of analyzing them under one and the same conceptual framework, the fragmentation between rule of conduct and rule of sanction, and the positive evaluation of regulation based on legal principles are premises that a functional analysis of administrative law should necessary reject.
